Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website jointoprealty.com, all related platforms, services, and tools operated by Top Realty LLC ("Top Realty," "we," "us," or "our").
By visiting our website, submitting an application, activating a subscription, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.
Eligibility
To use our services and join as a Founding Agent or Designated Broker, you must:
- Be at least 18 years of age
- Hold a valid, active real estate license in the state(s) in which you intend to operate
- Be legally authorized to work in the United States
- Not be subject to any suspension, revocation, or disciplinary action by a state real estate commission that would prevent you from practicing
- Agree to operate in compliance with all applicable federal, state, and local real estate laws and regulations
Top Realty reserves the right to verify your license status at any time and to deny or terminate access if eligibility requirements are not met.
Agent Agreement & Subscription
Founding Agents who join during our launch period lock in the $99/month flat fee for life — this rate will never increase for active Founding Agent accounts in good standing.
- Your $99/month subscription is billed on a recurring monthly basis via our payment processor
- Subscriptions auto-renew unless cancelled before the next billing cycle
- No refunds are issued for partial months or unused periods
- Failure to maintain an active subscription may result in suspension of your account, platform access, and revenue share eligibility
Pre-registering for a state that has not yet launched is free and non-binding. It reserves your place in line for that state's launch. No payment is collected until your state goes live and you choose to activate.
Commission & Revenue Share
Agents on the Top Realty platform keep 100% of their earned commissions. Top Realty does not take a commission split. Transaction fees are $0.
- Top Realty operates a 7-tier revenue share program based on agent recruitment activity
- Revenue share payments are calculated based on the active subscriptions of agents in your downline network
- Payments are made according to our published revenue share schedule, which may be updated from time to time
- Revenue share eligibility requires your account to be active and in good standing
- Top Realty reserves the right to audit, adjust, or withhold revenue share payments in cases of fraud, misrepresentation, or policy violations
- Revenue share income is not guaranteed and depends on your personal recruitment activity and the activity of your downline
All income earned through Top Realty is subject to applicable federal and state tax laws. You are solely responsible for reporting and paying taxes on any compensation received.
Broker Supervision
All agents operating under Top Realty must be supervised by a Top Realty Designated Broker licensed in their state of operation. By joining, you consent to this supervisory relationship and agree to comply with all directives, policies, and procedures established by your Designated Broker.
You acknowledge that your Designated Broker is responsible for your real estate activities in accordance with state law, and you agree to provide all information and documentation required to fulfill that supervisory obligation.
Acceptable Use
You agree not to use our website, platform, or services to:
- Violate any applicable law, regulation, or professional licensing requirement
- Misrepresent your credentials, license status, or affiliation with Top Realty
- Engage in deceptive, fraudulent, or misleading recruitment practices
- Transmit spam, unsolicited messages, or unauthorized advertising
- Scrape, copy, or reverse-engineer any portion of our platform or content
- Interfere with or disrupt the security or performance of our systems
- Use our brand, name, or marks without prior written authorization
- Recruit agents away from Top Realty to competing brokerages while actively affiliated with us
Violation of these terms may result in immediate termination of your account without refund.
Intellectual Property
All content on jointoprealty.com — including but not limited to text, graphics, logos, icons, images, training materials, and software — is the property of Top Realty LLC and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any of our content without our express written permission. Agents are granted a limited, non-exclusive, non-transferable license to use Top Realty branded materials solely for the purpose of marketing their Top Realty affiliation, in accordance with our brand guidelines.
Disclaimers
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that our platform will be uninterrupted, error-free, or free of viruses or other harmful components.
Top Realty does not guarantee any specific level of income, commission, or revenue share earnings. Results depend entirely on individual effort, market conditions, recruitment activity, and other factors outside our control.
Any income figures or examples referenced in our marketing materials are illustrative only and not a guarantee of results.
Limitation of Liability
To the fullest extent permitted by law, Top Realty LLC, its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, loss of data, or loss of business opportunities — arising out of or related to your use of our services.
Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to Top Realty in the three (3) months immediately preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Top Realty LLC and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to our services
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Any real estate transaction or professional conduct in connection with your activities as an agent affiliated with Top Realty
Termination
Either party may terminate the agent relationship at any time. You may cancel your subscription through your account settings or by contacting us at legal@jointoprealty.com.
Top Realty reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms, applicable law, or professional standards — including license revocation, fraud, or conduct detrimental to Top Realty or its agents.
- Your access to the platform and all associated tools will be revoked immediately
- Your eligibility for ongoing revenue share payments will cease
- You must transfer your license affiliation to another broker within the timeframe required by your state
- Revenue share payments already earned and vested prior to termination will be paid according to our normal schedule
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
You waive any objection to the laying of venue in such courts and waive any claim that such courts constitute an inconvenient forum.
Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For material changes, we will notify you by email or by posting a prominent notice on our website.
Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
